Thanks for sharing this with the group, Dr. Joe.
Since you published these accusations to the group,
may I please defend myself with FACTS?

1) I have never mentioned any outside site in a Dr. Joe forum. NEVER.

2) I was acting as an authorized David Elliott thinkscript code distribution site with David Elliott's explicit blessings until these complaints of pornography arose. David Anderson requested that I remove the material and I instantly did. 

3) Below, I am presenting the correspondence that took place between the complainant and myself. Could there have been a more cooperative tone?

4) THERE WAS NO COPYRIGHT CLAIM APPEARING IN THE CODE. I have printed out all the first few lines of code of the alleged copyright violations. Nowhere in the code does it announce a copyright by David Anderson. The only mention of copyright is " Mostly copywrite thinkorswim, inc. (2007)" (sic) Thinkorswim has never contacted me to complain about copyright issues, and to this very day, there are many many thinkscript studies available for download from my "unnamed", site, which is a non-commercial venue for traders to learn from each other. Here is my site's description: "A very well behaved group of super nice people who are interested in the markets and happy to share questions, ideas and compliments with each other, all the while trying to develop their edge that they can use to slaughter the competition. email gregfarber at gmail if you'd like to join! Nice hat! "

If you are new to thinkorswim, please take a look at the readme.txt file. There are useful tips on how to load studies and change common settings to match David Elliott's screenshow. The most common configuratin problems have solutions there as well.

Please remove any studies I've written or enhanced or distributed from your website. All of these studies contain copyright and confidential material you are not authorized to distribute. They'll be easy to find as they contain my email address.

Perhaps I'm a fool and surely I'm way too trusting, or just too old. I don't publish your private e-mail address to the world and I consider it a common courtesy for others to do the same for me. I've received 3 pornographic email tonight, complete with photos. These are the first in several years. I'm not a big believer in long-shot coincidence. Are you?

I am sorry to have caused you any distress. I have removed the scripts that came from your studies.zip file. Please let me know if I you come across any more of your work on my site and I will take it down.
I see that you wish to keep your email address confidential and I respect that.
I also see that you were supporting people who were having trouble with the scripts from the google site, and I am sorry about that too!
I am genuinely sorry that you received some pornography in the email. by the way, my email address is published to the world, it's just that I have a gmail address and it catches pretty much all of the spam. You can also run your domain email through Google. It's called Google Apps. Really cool and free.

I've received a number of inquiries today with regard to the studies, removal of the studies from your site, the removal of studies.zip from my site etc. I've prepared a response. I can't put it on the site, since I'm not a member. So publish it not not, whatever. It's your site.

You might want to consider using logon security so the spambots don't have free reign. Do you really have 4000+ emails in your inbox? Yikes!

A few years back the Google user agreement stated that Google owns the copyrights to everthing published on any of their sites or that flows throught their e-mail system, regardless of who the actual author is. Don't know if it's still true or not. I personally couldn't agree to it so I never use them for anything. Everything I've written, modified or maintained contains parts that are copyright TOS and/or contributed by third parties. If the Google copyright issues still exists, I don't know that I could legally post to your site even if I wanted to. It's something to consider.

Good afternoon,

Last evening I discovered that studies I've written, modified, maintained, whatever, were published on "the google site" without permission. I asked Greg to remove them and he did so. Thank you. As I'm not a member of the group and not allowed to post here, I have asked Greg to post this on my behalf in order to help clarify the situation.

As most of the 100+ members of my studies update group will attest, I give freely of both my time and talent (and studies) to anyone that asks. Anyone. No one has ever been denied. And contrary to a direct condemnation I received this morning I've never charged a dime for anything. And I'm not looking to "get rich of the backs of working stiffs." And I definitely don't believe for a second that taking the time to write studies and understand the details of how studies work could possibly make me a "really bad trader." I believe understanding the how and why of the studies has helped me immensely. I encourage anyone to nitpick the details of these studies, understand their intimacies and apply that knowledge to their trading decisions. It's not like any of it's a proprietary trade secret. I might add that David's almost constant instruction over the last three months has been a huge huge factor in my success as well.

Back to the crux of the matter. I have not received any request from anybody at anytime, ever, to publish anything in the google group. Not one. Nada. The studies.zip file was downloaded to 311 unique IP addresses (many multiples to some addresses) in March and distributed to 100+ people via e-mail.  There is probably some overlap between the two groups. From these facts I draw the following conclusions:
1) There is no interest in having the material published at the "google site."
2) The 400+? people I'm dealing with directly are being adequately serviced.
3) Publishing at the "google site" is more work for me with no benefit to anyone else.

Of course I could be wrong. If there's any actual interest in having these materials published at the "google site" let me know (david477xf@pc3i.com) and I'll try to work something out with Greg. I don't read minds. I won't even consider it unless I receive at least 1 actual request. Please note the change in my email address. My old address, which I've used for eight years, and of which I've grown quite fond, will be permanently directed to the SPAM folder effective at midnight. Going forward I'll only be using easily disposable addresses on ToS and in the studies. I'll be changing them at the first sign they've been compromised, daily if necessary. I've never considered myself to be a prude, but some of the emails I've received in the last 16 hours would make a billy-goat blanch.

Was it also true that this "code" was being freely distributed from the complainant's pci3.com website?
 and it had his email address listed in it, so how does the porn thing come into play again? And I don't think you can call a modified tos thinkscript study YOUR copyrighted code. If the copyright belongs to anybody, I'd hazard a guess that it belongs to thinkorswim.
